The project of Strengthening the System of Misdemeanor Rights and Misdemeanor Courts and Implementation of the Misdemeanor Law coordinated by Magistrate Dragana Tireli was held in Pozega on February 12th. The training was attended by 29 magistrates from the Uzice Misdemeanor Panel and a police officer from Pozega.
Lecturers at the training were: Miroslav Simic MA – Public Prosecutor, held a lecture on the subject of The Role of a Public Prosecutor and a Defense Attorney in a Misdemeanor Proceeding, Nebojsa Vesic – President of the Smederevo Misdemeanor Panel, held a lecture on the subject of Guiltiness-Guilt in a Misdemeanor Proceeding and The Elements that Exclude The Existence of the Misdemeanor, and Milenko Mijic – Magistrate from Municipality Misdemeanor Office in Sabac, held a lecture on the subject of The Working Out of the Verdict in The Misdemeanor Proceeding.
Once again novelties implemented in our new way of training were accepted excellently by magistrates who, with pleasure, participated in the workshops. Trial simulation was carried out through the workshop and certain tasks as Write the Verdict, Pass the Verdict were assigned... Again, discussion brought up the problem appearing from the start that due to bad financial situation of the authorities not all are able to get their copy of The New Law and because of that not all are informed well about the changes regarding the old Law. Commentaries at the end were positive and nearly all magistrates said that passing through our workshop would mean a lot to them when they start working under the New Misdemeanor Law.
After a short pause made by Magistrates’ Association due to Christmas and the New Year we have continued our work and on 05.02.2007 we held a practical training in Smederevo. New series of practical trainings have been changed thus giving much more time for discussion and practical tasks in the workshop. According to the evaluations that have been filled up at the end of the training the participants were delighted by our new way of training and manifested it by their maximal participation in the workshops and discussion.
Training was attended by 31 Magistrates from the Smederevo Misdemeanor Panel area. Except for the novelties that have been implemented in the new way of training there has been the change of lecturers and of their topics, too. Time needed for the lectures has been cut down in order to get as much time as possible for the practical workshops.
Delightful reaction that we have got in return at the end of the workshop gave us the additional strength and motive to make our workshops better and that our training does not skip any of the magistrates from The Republic of Serbia.
On December 11th.in hotel “Grand”, Valjevo, another practical trainings project on “Strengthening the systems of Misdemeanor law and Misdemeanor Courts and implementation of the Law of Misdemeanor” took place, aiming to educate misdemeanor judges in connection to implementation of the New Law of Misdemeanor being enforced on January the 1st. 2007. The project coordinator is Dragana Tireli, Belgrade District Court Judge.
The training was attended by 32 magistrates from the sphere of Council for misdemeanor in Valjevo and members of the local police. All the judges were more than interested in the subject matter and the discussion brought up many questions and remarks at the end. They have pointed out, as the major problem, the fact that the copy of the New Law by which they are to judge from January the 1st. 2007, was not received by their township officials. They were also interested at the themes prepared by Simic Miroslav MA, Public Prosecutor. We have noticed that among the present are magistrates who had already participated in our earlier training what tells us of their interest for the themes. It was concluded besides very good communication at the end of the training that these trainings should be a little different in other words it is necessary to include magistrates into the discussion from the very beginning of the training and not to wait until the end (to introduce the classical workshop type of work).
Lecturers at the seminar were: Prof.Dr. Stanko Bejatovic - professor at the Kragujevac University held a lecture on the subject of Felony vs. Misdemeanor ,Felony vs. Economic misdemeanor and Criminal Charges-Main Hearing, Dr.Nedeljko Jovancevic - lawyer, member of the Serbian Bar Association held a lecture on the subject of The Role of a Defense Attorney, Miroslav Simic MA - Public Prosecutor, held a lecture on the subject of The Role of a Public Prosecutor in a Misdemeanor Trial and Disposition with a Claim When There Is No Open Hearing.
